A driver suspected of being drunk at the wheel is facing charges related to the death of his passenger after he struck a dump truck in Brooklyn on the morning of July 9. New York authorities plan to arrest the 26-year-old driver following the car accident that killed his 22-year-old passenger. A second passenger thankfully survived the incident.
According to the report, the driver was traveling south on Utica Avenue when the accident occurred. The vehicle crashed into a northbound dump truck as the other vehicle was turning onto the road around 1:30 a.m. The force of the impact seriously injured one passenger and also injured both the driver and the second passenger. The driver of the dump truck appeared to have been unharmed in the crash.
All three individuals were taken to a local hospital, where the critically injured passenger was later pronounced dead. The driver and the second passenger are said to be in stable condition as of this writing. Charges are expected to be filed against the driver, who police say exhibited signs of being intoxicated behind the wheel, though it is unclear whether blood tests or other toxicology scans have confirmed that estimation at this time.
If the driver is found guilty of DUI, he will face serious criminal charges related to the death of his passenger in the car accident. Additionally, the deceased man's family could be entitled to file a wrongful death lawsuit in a New York civil court against the driver. Any evidence used to implicate the man in the criminal suit can be used in the civil suit, as well.
